Terms of Service

FinSimTrading is an educational platform for financial literacy, AI-assisted learning, certification and simulated trading. These Terms explain what you can expect from us and what we expect from you.

1. Acceptance of Terms

These Terms of Service ("Terms") form a binding agreement between you and [COMPANY LEGAL NAME], operator of FinSimTrading at finsimtrading.com (the "Platform"). By creating an account, signing in, subscribing, submitting a competition entry, or otherwise using the Platform, you accept these Terms and the policies referenced in them.

If you do not agree, do not use the Platform. If you are accepting on behalf of a school, district, employer or other organization, you represent that you are authorised to bind that organization.

Continued use of the Platform after we publish an updated version of these Terms constitutes acceptance of the updated Terms.

2. Educational Purpose Only

FinSimTrading is an educational platform. We do not provide financial, investment, brokerage, securities, legal, accounting or tax advice, and nothing on the Platform is a recommendation, offer or solicitation to buy, sell or hold any security or other asset.

All trading on the Platform is simulated using virtual currency (VCcoins, or "VC"). No real securities are bought, sold or custodied, and no brokerage or advisory relationship is created between you and us.

You are solely responsible for any decision you make using material learned on the Platform, and you agree to consult a licensed professional before making a real-world financial decision.

3. Eligibility

Accounts may only be created and operated by individuals aged 18 or older. If the learner is under 18, a parent, legal guardian, teacher or authorised school administrator must create the account, remain the account holder, and supervise all activity.

You may not use the Platform if you are barred from doing so under applicable law, or if we have previously terminated your account for a policy violation.

4. User Accounts

You agree to provide accurate registration information and to keep it current. One person may hold one personal account unless we agree otherwise in writing.

4.1 Account security

  • Keep your password confidential and do not share account credentials.
  • Use a unique password and enable any additional security features we offer.
  • Notify us immediately at [SUPPORT EMAIL] if you suspect unauthorised access.
  • You are responsible for activity that occurs under your account, except to the extent caused by our failure to maintain reasonable security.

4.2 School accounts

Schools, districts and educational institutions may purchase licences that create and administer accounts on behalf of learners. The institution is the account owner, controls seat assignment, and is responsible for obtaining any consents required by law before enrolling learners.

4.3 Teacher accounts

Teacher accounts can create classes, assign lessons and competitions, view learner progress, issue certificates, and export reports for the learners assigned to them. Teachers must use learner data only for legitimate educational purposes.

4.4 Student accounts

Student accounts created under a school or family plan are administered by the institution or plan owner, who may view progress, reset the account, or remove access. Students must follow their institution's rules in addition to these Terms.

4.5 Organization accounts

Employers, non-profits, competition organisers and other organizations may purchase seats for program participants. Organization administrators may view participation and performance data for their assigned seats only.

5. Subscription Plans, Billing and Auto-Renewal

The Platform offers a free trial and paid subscription plans, plus optional paid competitions and events. Plan features and prices are shown at checkout and on our pricing page.

5.1 Free trial

New accounts receive a time-limited free trial of paid features with no payment method required. When the trial ends, access to paid features stops unless you subscribe.

5.2 Billing

By subscribing you authorise us and our payment processor to charge your selected payment method the amounts and at the intervals shown at checkout, including applicable taxes. We do not store full card numbers.

5.3 Auto-renewal

Subscriptions renew automatically at the then-current price for successive periods until cancelled. You may cancel at any time from your account page; cancellation stops future renewals and takes effect at the end of the current billing period.

5.4 Refunds

Refund eligibility is described in our Refund & Subscription Policy, which forms part of these Terms.

5.5 Price changes

We may change prices, plan features or fees with reasonable advance notice before your next renewal. Your continued subscription after the effective date constitutes acceptance.

6. Acceptable Use

You agree to use the Platform lawfully and respectfully, and to comply with our Acceptable Use Policy and Community Guidelines, which are incorporated into these Terms by reference.

Prohibited activity includes fraud, harassment, cheating, manipulating simulations or leaderboards, unauthorised automation, reverse engineering, uploading malware, and attempting to access accounts or data you are not authorised to access.

7. Intellectual Property

7.1 Our content

Except for User Content, all material on the Platform — lessons, curricula, videos, narration, question banks, simulations, software, designs and databases — is owned by [COMPANY LEGAL NAME] or its licensors and protected by copyright and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Platform for your own education or, for licensed institutions, for classroom instruction within the licensed seat count.

7.2 Trademarks

"FinSimTrading", the FinSimTrading logo and related marks are our trademarks. You may not use them without prior written permission, except to refer factually to the Platform.

7.3 Restrictions

  • Do not copy, resell, sublicense, publicly redistribute or create derivative works from Platform content outside the licence above.
  • Do not scrape, mine or bulk-download content, or use it to train machine-learning models without our written consent.
  • Do not remove copyright notices or circumvent access controls.

8. User Content

"User Content" means anything you submit: research reports, essays, stock pitches, portfolio notes, messages, uploads and profile information. You keep ownership of your User Content.

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt for display, score, excerpt and publish your User Content together with your display name, grade level, scores and ranking for the purposes of operating the Platform, judging competitions, generating leaderboards and certificates, and showcasing educational examples.

You represent that your User Content is original, does not infringe anyone's rights, and contains no confidential, defamatory or unlawful material. We may remove User Content that violates these Terms.

9. AI-Generated Content

The Platform uses artificial intelligence to generate lessons, explanations, practice questions, portfolio feedback, study plans and tutoring responses. AI output is educational, may be incomplete or inaccurate, and must be independently verified before being relied on for any financial, legal, tax or investment purpose.

Your use of AI features is also governed by our AI Usage Policy. Do not submit sensitive personal information, credentials or confidential material to AI features.

10. Simulated Trading and VCcoins

VCcoins are an in-app scorekeeping feature with no cash or monetary value. They cannot be purchased with, exchanged for or redeemed as real money, and cannot be sold, transferred, gifted, withdrawn or inherited.

Simulated balances, gains, losses, rankings and returns are hypothetical. They do not reflect real trading costs, taxes, slippage, liquidity or execution, and are not indicative of any real-world result.

We may adjust, reset or remove VCcoin balances at any time — for example to correct errors, restart a season, or address misuse — without compensation.

11. Certificates, Badges and Leaderboards

Certificates and digital badges recognise completion of Platform activities. They are not accredited qualifications, professional licences or evidence of securities expertise, and we make no guarantee that any third party will recognise them.

We may verify, reissue or revoke a certificate or badge obtained through cheating, misrepresentation or error. Leaderboards display limited profile information (display name, plan cohort, score and rank) to other participants in the same plan or competition.

12. Competitions and Events

Individual competitions and events may have additional rules published on their pages, including entry fees, deadlines, judging criteria and prizes. Where those rules conflict with these Terms, the competition rules control for that competition.

  • Entries must be your own original work and must comply with our Acceptable Use Policy.
  • Participants under 18 require parent/guardian or school consent, including a typed guardian signature where requested.
  • Judging is at the organiser's discretion and decisions are final.
  • Entries may be disqualified for plagiarism, undisclosed AI generation, late submission, missing consent or rule violations.
  • Prizes, where offered, are non-transferable, may be substituted for items of equal value, and any tax obligation is the recipient's responsibility.

13. Marketplace and Optional Add-Ons

If we make optional add-ons available (for example downloadable curriculum packs, event tickets or third-party learning content), the listing page will state the price, licence scope and any refund conditions. Add-ons are licensed, not sold, and remain subject to these Terms.

14. Third-Party Services and Market Data

The Platform integrates third-party services including market data providers, news feeds, authentication providers, payment processors, email delivery and cloud hosting. Market data, prices, charts, earnings figures and headlines are provided "as is" and may be delayed, incomplete or inaccurate.

Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party content or availability.

15. Suspension and Termination

You may stop using the Platform or delete your account at any time. We may suspend or terminate an account, remove content, or restrict features if we reasonably believe there has been a violation of these Terms, a risk to other users or the Platform, non-payment, or a legal requirement.

Where practical and lawful, we will give notice and an opportunity to remedy. On termination, your licence to use the Platform ends; sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification and governing law) survive termination.

16. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant uninterrupted or error-free operation, and we may change, suspend or discontinue features at any time.

17. Indemnification

You agree to indemnify and hold harmless [COMPANY LEGAL NAME], its owners, officers, employees, instructors, contractors, affiliates and licensors from any claim, demand, loss, liability or expense (including reasonable legal fees) arising out of your User Content, your misuse of the Platform, your violation of these Terms, or your violation of any law or third-party right.

18. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, lost opportunity or lost goodwill, arising out of or relating to the Platform.

Where liability cannot be excluded, our total aggregate liability is limited to the greater of (a) the amounts you actually paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) USD $50.

Some jurisdictions do not allow certain exclusions; in those places these limits apply only to the extent permitted.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of [STATE/COUNTRY OF GOVERNING LAW], without regard to conflict-of-law rules. The courts located in [COURTS / ARBITRATION VENUE] have exclusive jurisdiction, unless mandatory local law grants you a different forum.

19.1 Informal resolution

Before filing a claim, contact us at [LEGAL EMAIL] and give us 30 days to resolve the dispute informally.

19.2 Arbitration (optional clause — confirm with counsel)

If elected by [COMPANY LEGAL NAME] in its published dispute policy, disputes not resolved informally will be settled by binding individual arbitration administered in [COURTS / ARBITRATION VENUE] under the rules of [ARBITRATION BODY]. Claims must be brought individually and not as a class action, except where such a waiver is unenforceable. Small-claims actions and requests for injunctive relief regarding intellectual property are excluded.

20. Force Majeure

We are not liable for failure or delay caused by events beyond our reasonable control, including natural disasters, war, civil unrest, labour disputes, epidemics, government action, internet or power outages, cyber-attacks, or failures of third-party providers.

21. Updates to These Terms

We may update these Terms as the Platform evolves or the law changes. We will update the "Last updated" date and version number above and, for material changes, notify account holders by email or in-app notice. Your continued use after the effective date constitutes acceptance. We record the version you accepted, along with the date, for compliance purposes.

22. General

  • Entire agreement: these Terms and the referenced policies are the complete agreement between us.
  • Severability: if a provision is unenforceable, the rest remains in effect.
  • No waiver: failure to enforce a provision is not a waiver of it.
  • Assignment: you may not assign these Terms; we may assign them in connection with a merger, acquisition or asset transfer.
